المجلس الوطني لحقوق الإنسان " دسترة هيئة رقابية"

Résumé: ملخص قامت الجزائر بتعديل الدستور سنة 2016 ، و من بين ما تضمنه التعديل إنشاء مجلس وطني لحقوق الإنسان، أي دسترة هيئة رقابية في مجال حقوق الإنسان ، أسند لها الدستور نفسه عدة مهام تتمحور حول رصيد انتهاكات حقوق الإنسان و اتخاذ الإجراءات المناسبة بهذا الصدد، بالإضافة الى مهام أخرى محددة دستوريًا. هذه المهام الدستورية ، منها ما كان سائدًا في ظل اللجنة الوطنية الاستشارية و تمت دسترته ، و منها ما تم حذفه. و يترتب في هذه المهام الدستورية أن يعد المجلس تقريرًا سنويًا، يرفعه الى ريس الجمهورية و الى الوزير الأول و الى البرلمان، أي توسيع الجهات المبلغ لها تقرير المجلس، و بنص الدستور، بعدما كان التقرير ، في ظل اللجنة الوطنية الاستشارية يرفع فقط لرئيس الجمهورية. Algeria has amended the constitution in 2016, among the contents of these amandements the craetion of a National council of humain rights which is constututionalizing of a controlling authority in this field.The same is changed of several missions focusing on humain rights violations and the appropriate measures which should be taken in this regard.In addition to other specific mission , some of them were prevailled in the light of the national advisory committee then were constitutionalilised the rest was cancelled. Resulting to these constitutional missions, the council should yearly prepare a report to the president of the Republic , the prime Minister and to the parlement in a way to expand the noticed authorities. Previously , the reparting in the light of the national advisory committee was only to the president of the republic
