تسجيل عقد الزواج في سجلات الحالة المدنية

Résumé: ملخص: إن كل شخص يحمل الجنسية الجزائرية يسري على حالته المدنية القانون الجزائري و المتمثل في القانون 70-20 المتعلق بالحالة المدنية المعدل و المتمم، و فيما يخص تسجيل عقد الزواج و إجراءاته فتطبق في ذلك أحكام قانون الحالة المدنية كما يثبت بمستخرج من سجلات الحالة المدنية، و اسند المشرع اختصاص تسجيل عقود الزواج إلى الموثق أو الموظف المؤهل قانونا، وفق إجراءات إدارية محددة قانونا هذا في الحالة العادية فيتم تثبيت و تسجيل عقد الزواج بين طرفين غير متنازعين باتباع الاجراءات القانونية المنصوص عليها في قانون الحالة المدنية المعدل. أما في حالة النزاع حول عقد الزواج بين طرفي العلاقة او ممن له مصلحة يتم تثبيته بموجب حكم صادر من قسم شؤون الأسرة لمحكمة موطن المدعى عليه إذا لم يتفق الطرفين على خلاف ذلك. Abstract: Every person who holds Algerian nationality applies to his civil status Algerian law represented in Law 70-20 related to the amended and supplemented civil status, and with regard to the registration of the marriage contract and its procedures, the provisions of the Civil Status Law are applied as evidenced by an extract from the civil status records, and The legislator has assigned the competence to register marriage contracts to a notary or a legally qualified employee, according to legally defined administrative procedures. In the event of a dispute over the marriage contract between the two parties to the relationship or those who have an interest, it is confirmed by a ruling issued by the Family Affairs Department of the court of the defendant’s domicile, if the two parties do not agree otherwise.
