دور العرف في إقرار الحقوق المعنوية

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على العرف كمصدرِ من مصادر التشريع الإسلامي في جانب المعاملات المالية المعاصرة على وجه الخصوص والتي تَنْبَثِقُ نتيجة التطورات الراهنة في العالم المعاصر والحقوق المعنوية نموذج لمثل هذه المستجدات والتي تمخضت عن التطورات الاقتصادية الحاصلة من حقوق الابتكار وحقوق التأليف وظهور المطابع .. .إلخ . ولأن للعرف ضوابط تحكمه لا يمكن الخروج عنها وبناء عليها يمكن للعرف أن يقرَّ حقوقا ويستجد أموالا لم تكن معروفة في الحياة المالية المعاصرة ،وأبرزها الحقوق المعنوية التي ظهرت كنتيجة لإعمال العرف المعاصر . كلمات مفتاحية : الحقوق المعنوية: العرف: المعاملات المالية : حقوق المؤلف: الفقه المعاصر Abstract: The custom is one of the sources of legislation in the aspect of modern financial transactions in particular, which has emerged as a result of current developments in the contemporary world. Moral rights emerged as a new type of money, which established contemporary custom and defined its finances through the acquaintance of people with their finances.
