العرف وأثره على الحقوق المعنوية للمحضون – دراسة فقهية قانونية –

Résumé: الملخص: يعتبر العرف مستندا عظيم الشأن في بناء الأحكام الشرعية في أبواب لا حصر لها في الفقه الإسلامي على اختلاف مذاهبه، ويأتي هذا البحث لإبراز مكانة العرف كدليل شرعي في استنباط الأحكام الشرعية والقانونية وبيان حجيته وشروطه المعتبرة مع إسقاط ما تم تحصيله من معطيات نظرية على الجانب العملي المتعلق بمنازعات الحضانة ومدى مراعاة القضاء لهذا المصدر الخصب والمتجدد والمتغير بتغير الزمان والمكان، وقد خصصنا هذه الدراسة لتبيان أثر العرف على أحد الجوانب المتعلقة بالحقوق المعنوية للمحضون وهما: تحديد مدة انتهاء الحضانة وتنظيم الحق في الزيارة. Abstract: Custom is considered a great document in the construction of legal rulings in countless chapters in Islamic jurisprudence of its various schools, and this research comes to highlight the position of custom as a legal guide in deriving legal and legal rulings and to indicate its authority and its considered conditions with dropping what has been obtained from theoretical data on the practical aspect related to Custody disputes and the extent to which the judiciary takes into account this fertile, renewable and changing source with the change of time and place.
