العقد الإطار كقالب للعقود المستقبلية اللاحقة( دراسة تحليلية في ضوء القانون المدني الجزائري)

Résumé: ملخص: يؤسس العقد الإطار أكثر من وعد بالتعاقد المشار إليه في المادتين 71 و72 من القانون المدني الجزائري؛توطئة أو مقدمة للعلاقات التعاقدية،ليغدو مجرد إطار لا يمكن تنفيذه إلا من خلال عناصر العقود المستقبلية التي ينظمها ووافق عليها الطرفان فعليا، إذ هو مرتبط وجودا وعدما بها، فلا وجود لعقد إطار دون عقود تطبيقية لاحقة.الأمر الذي يجعل من عقود الأعمال والمشاركة أو التعاون التجاري وبخاصة عقد التوزيع الأنموذج الأمثل لهذا الشكل التعاقدي،إذ يرتبط الممون بالموزع في شكل يكتسي شكل عقد إطار زمني ذي تنفيذ مستمر قائم على الاعتبار الشخصي، يتم تنفيذه من خلال طلبيات توصف بالعقود التطبيقية. Abstract: The framework contract is more than a contractual promise, as mentioned in articles 71 and 72 of Algerian civil code, where it is considered as a kind of preamble to contractual relations.it thus appears as a simple framework which will serve for the subsequent conclusion of the application contracts. The framework contract exists only because it will be followed by the conclusion of implementation contracts, and there can be no framework contract without implementing contracts. What makes business and partnership contracts or commercial cooperation contracts, and especially the distribution contract, the very archetype of this contractual figure, under which the supplier and the distributor will enter into a contractual relationship-framework, successively executed and of a personal nature, punctuated by orders qualified as “application contract”.
