إلحاق ولد الاغتصاب دون ولد الزنا وفقا للأحكام الفقهية و التطبيقات العلمية و القضائية.

Résumé: الملخص : لقد أثار نسب الولد غير الشرعي خلاف وجدل فقهي كبير لدى الفقهاء القدامى والمعاصرين بين مؤيد لإثبات نسبه ومعارض لذلك، في حين ذهب اتجاه آخر إلى التمييز بين نسب ولد الزنا وولد الاغتصاب فنفى النسب عن الأول وأثبته إلى الثاني وذلك في محاولة للانتصار للمرأة ولدها في عملية الاغتصاب إذ أنها لم تتواطأ مع الجاني في فعله فهي مكرهة كما أنها لم تسعى للحصول على هذا الحمل ،وعليه لن تتحمل عاقبة الفعل وحدها بخلاف المرأة في عملية الزنا ،وبما أن الاغتصاب لا يعد سبب لثبوت النسب فكان لا بد من البحث عن أساس فقهي وقانوني يمكن الاحتكام إليه في إثبات نسب ولد الاغتصاب . وعليه كيَف الاغتصاب انه وطأ بشبهة لاعتبارات في المسألة ،وبالتطور العلمي الحاصل وظهور البصمة الوراثية كدليل علمي ذا حجية في الإثبات والنفي Kطرح السؤال الفقهي والقانوني حول إمكانية الاستعانة بهذا في إثبات نسب ولد الاغتصاب. Pedigree of illegitimate child raised a serious dispute and jurisprudential debate to the old and contemporary scholars between those who are with proofing pedigree and those who are against ,while others preferred to distinguishing between illegitimate child and rape child, it denied pedigree from the first and proved to the second and in try to making the woman and her child win in rape, as she didn’t agree instead she was forced as well as she was not seeking to get. Pregnancy as a resutt she does not have to face the results by her own like the woman in adultery because rape is not considered as reason to prove pedigree so a search had to be done not prove pedigree Of rape child ,based on that rape u considered as on agreement , and with the scientific development , and the coming of D.N.A as a scientific evidence in roofing or denying pedigree , a juris prudential and legal uestion was asked about the possibility of the use of this cientific evidence to prove pedigree of rape child
