الحماية الجزائية للسر المصرفي في التشريع الجزائري

Résumé: تعتبر السرية المصرفية موضوعا هاما ومرتبطا بالنظم الاقتصادية الحديثة. تتناول هذه الدراسة النظام القانوني للسرية المصرفية في التشريع الجزائري. وسوف يعتمد بشكل أساسي على تحليل النصوص التي تناولت السرية المصرفية وفق القواعد العامة للتشريع الجزائري، إذ لا يوجد قانون خاص بالسرية المصرفية في الجزائر. ومن ثم فإن مبدأ السرية المصرفية يتضمن استثناءات عديدة لحماية مصالح غير مصلحة العميل، تفرضها متطلبات تفوق مصلحة الأخير من حيث ضرورة مراقبة النظام المصرفي وتبادل المعلومات بين البنوك، وطنيا ودوليا. دوليا. كما أن ظاهرة غسيل الأموال قللت من أهمية مبدأ السرية المصرفية في البنوك على المستوى الوطني والدولي من خلال رفع السرية وفرض رقابة صارمة عند فتح الحساب من قبل العميل واعتماد معيار “اعرف عميلك”. Banking confidentiality is an important topic and linked to modern economic systems. This study deals with the legal system of banking confidentiality in Algerian legislation. It will be mainly based on the analysis of texts which dealt with banking confidentiality according to the general rules of Algerian legislation, because there is no specific law on banking confidentiality in Algeria. Thus, the principle of banking confidentiality includes numerous exceptions to protect interests other than the interest of the client, imposed by requirements that exceed the interest of the latter in terms of the need to control the banking system and exchange information between banks, both nationally and internationally. Likewise, the phenomenon of money laundering has lessened the importance of the principle of banking confidentiality in banks at the national and international level by lifting secrecy and imposing strict control when opening an account by the customer and adopting the “Know your customer” standard.
