أحكام الهيئة الشرعية الوطنية للإفتاء للصناعة المالية الإسلامية في الجزائر

Résumé: تهدف هذه الدراسة إلى بيان أحكام الهيئة الشرعية الوطنية للإفتاء للصناعة المالية الإسلامية في الجزائر، والتي تعتبر حجر الزاوية في منظومة الصناعة المالية الإسلامية، من خلال التأطير والمتابعة والمراقبة الشرعية لمدى مطابقة المنتجات للشريعة تبعا لأحكام النظام 20-02 المحدد للعمليات البنكية المتعلقة بالصيرفة الإسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية؛ من منطلق أن الكثير من المتعاملين يتطلعون إلى معاملات تتوافق وأحكام الشريعة الإسلامية، فضلا عن الأهمية الضبطية لهذا النوع من الرقابة، وعلى اعتبار أن تجربة الصيرفة الإسلامية حديثة عهد بالتطبيق في الجزائر، خلصت هذه الدراسة إلى أن هذه الهيئة تتمتع بالاستقلالية التامة عن بنك الجزائر، لكن نطاق رقابتها يقتصر في الجوانب المحددة في نظام إنشائها، وهي منح أو عدم منح شهادة المطابقة الشرعية، ومساندة البنك المركزي في توطين الصيرفة الإسلامية، لإضفاء الثقة لدى المتعاملين في عمليات الصيرفة الإسلامية بالجزائر. This study aims to clarify the provisions of the National Sharia Board for Fatwas for the Islamic financial industry in Algeria, which is considered the cornerstone of the Islamic financial industry system, through framing, follow-up and Sharia control of the extent to which products comply with Sharia in accordance with the provisions of Regulation 20-02 that specifies banking operations related to Islamic banking and its rules of practice. by banks and financial institutions; On the basis that many dealers are looking forward to transactions that are compatible with the provisions of Islamic Sharia, as well as the regulatory importance of this type of control, and given that the experience of Islamic banking is recent in application in Algeria, this study concluded that this body enjoys complete independence from the Bank of Algeria, but The scope of its oversight is limited to the aspects specified in the system of its establishment, namely granting or not granting a Sharia conformity certificate, and supporting the Central Bank in the localization of Islamic banking, to give confidence to dealers in Islamic banking operations in Algeria.
