الإذعان في عقود التجارة الإلكترونية

Résumé: الملخــص: مع التطور الهائل لشبكة الانترنت أصبح موضوع حماية المستهلك الإلكتروني يثير الكثير من الجدل، وقد بدأت الحاجة لحماية المستهلك في السوق الالكترونية في ظل اختلال التوازن العقدي بين المستهلك والمحترف. فالمبدأ العام في العلاقات التعاقدية هو التراضي، إلا أن تطور الأوضاع الاقتصادية والتفاوت في المراكز المالية بين هذه الأطراف، دفع أحدهم لإملاء شروطه على الطرف الآخر دون مناقشته، وهذا النوع من العقود أطلق عليها اصطلاح عقود الإذعان. Abstract: With the huge development of the internet, the matter of protecting the electronic consumer is raising a lot of controversy, as the need to protect the consumer in the electronic market began in light of the imbalance of contracts between the consumer and the professional. The general principle in contractual relations is mutual consent but the development of economic conditions and the disparity in the financial positions between these parties prompted one of them to dictate his terms on the other party without discussing them, and this type of contracts is called the contract of adhesion.
