حماية المستهلك الإلكتروني من الشروط التعسفية والإذعان

Résumé: تعتبر السوق الإلكترونية ملاذا مهما للمستهلك على المستوى الوطني والدولي ، لهذا فهو يحتاج للحماية فيها مثل حاجته للحماية في السوق التقليدية، بل أكثر ،نظرا لخصوصية البيئة المتعاقد فيها وما تتضمنه من مخاطر للمستهلك ،فعند ولوجه شبكة الأنترنت ،يواجه عدة مخاطر يجب حمايته منها كالجهل بمضمون العقد وشخصية الطرف الآخر لانعدام المعاينة المادية، وعند ابرام عقد الاستهلاك يجب حمايته من الشروط التعسفية بسبب طبيعة هذا العقد الإذعاني، وأيضا حماية المنتوج محل العقد وحماية شكلية من واعطائها القوة الإثباتية اللازمة، مع حماية بيانات المستهلك الخصوصية من القرصنة بأساليب تقنية كالتشفير من العقد ،أما في مرحلة تنفيذ العقد فيجب ضمان الحقوق المكفولة وفقا للقواعد العامة للعقود ،وخلوه من العيوب ،وضمان التعرض، أو الحقوق المستحدثة بنصوص خاصة بحماية المستهلك سواء وطنية أو دولية ،كالحق في ضمان سالمة المستهلك وحقه في المطابقة والضمان ما بعد البيع، وحقه في العدول ،وحماية المستهلك الالكتروني من مخاطر الدفع الالكتروني، وهذه الحقوق في جميع المراحل يجب أن تدعمها آليات قوية لتفعيلها وتطبيقيا، وزيادة ثقة المستهلك الإلكتروني ،كالتوثيق الإلكتروني ،والهيئات والجمعيات والمواقع المهتمة بشؤون المستهلك ،والقضاء كآخر ملجأ حماية لها. الكلمات المفاتحية: المستهلك الالكتروني ، الشروط التعسفية ، الإذعان ، العدول ،الدفع الالكتروني.
