الترجيح البيئي في منح الصفقات العمومية -دراسة مقارنة-

Résumé: ملخص: عالجت الدراسة اشكالية مدى مشروعية ترجيح المعيار البيئي في منح الصفقات العمومية في ظل غياب النص القانوني الحاسم في المفاضلة بين معيار العرض الأقل سعرا والعرض الاحسن من الناحية الاقتصادية. وقد كشفت الدراسة عن وجود أسس قانونية وقضائية تبرر لمنهجية ترجيح المعيار البيئي على المعايير الاخرى وفقا لضوابط تتعلق بموضوع الصفقة واحترام المبادئ الاساسية في ابرام الصفقات العمومية. وانتهت الدراسة الى ضرورة تقنين دمج المعيار البيئي في كل مراحل ابرام الصفقات العمومية مراعاة لمبدأ التنمية المستدامة وما يقتضيه من حتمية تخضير الشراء العمومي حماية للبيئة. كلمات مفتاحية: التنمية المستدامة، البعد البيئي، الصفقات العمومية الخضراء، الترجيح البيئي، حماية البيئة. Abstract: The study addressed the problematic extent of the legality of dimenssion the environmental criterion in awarding public procurements in the absence of a decisive legal text in the comparison between the criterion of the lowest price offer and the best offer in economic terms. It revealed the existence of legal and judicial bases that justify the methodology of weighting the environmental standard over other standards according to controls related to the subject matter of the transaction and respect for the basic principles in concluding public transactions. It concluded that it is necessary to codify the integration of the environmental standard in all stages of concluding public procurements, taking into account the principle of sustainable development and the inevitability of greening public procurement to protect and preserve the environment.
