تكريس البعد البيئي في مجال تنفيذ صفقة الأشغال العامة على ضوء المرسوم التنفيذي 21-219

Résumé: ان حماية البيئة في اطار التنمية المستدامة في مجال الصفقات العمومية للأشغال حظيت باهتمام المشرع الجزائري عندما ادرج البعد البيئي ضمن المرسوم الرئاسي 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، وكرسه بموجب المرسوم التنفيذي 21-219 المتضمن الموافقة على دفتر البنود الإدارية العامة المطبقة على الصفقات العمومية للأشغال من خلال آليات قانونية تتمثل أساسا في السلطات الممنوحة للمصلحة المتعاقدة في مواجهة المتعامل المتعاقد معها اثناء تنفيذ التزاماته التعاقدية. ان الاهتمام بالمجال البيئي في صفقات الاشغال العامة عرف تطورا ملحوظا، خاصة مع صدور المرسوم التنفيذي السابق ذكره، الا انه لم يحظى بمواد كثيرة تعطي المصلحة المتعاقدة القوة الإلزامية الكافية لمواجهة المتعاقد معها لحماية البيئة. Protection of the environment in the context of sustainable development in the field of public works transactions has received the attention of the Algerian legislature when it included the environmental dimension in Presidential Decree 15-247 containing the regulation of public transactions and the mandates of the General Facility and was devoted by Executive Decree 21-219 to the approval of the General Administrative Clauses Book applicable to public works transactions through legal mechanisms consisting primarily of the powers conferred on the contracting interest to confront its contractor during the exécution of its contractual obligations. Interest in the environmental area in public works deals has developed remarkably, especially with the issuance of the aforementioned Executive Decree, but it has not received much material that gives the contracting interest sufficient compulsory force to confront the contractor's environmental protection.
