مرحلة التفاوض وأثرها على تحقيق الأمن التعاقدي في عقود الاستثمار الدولية

Résumé: إن مرحلة التفاوض هي تقنية حديثة وليدة الممارسات العقدية الدولية في مواجهة و مجابهة اختلال التوازن في عقود الاستثمار الدولية ، ولقد أبانت هذه المرحلة على مرونة في معالجة أي اختلال يهدد أمن العقد ، وهذا ما يعطي لها المفاضلة في عقود الاستثمار الدولية ، بالرغم من وجود تقنيات قانونية أخرى توفر حلول لمشكلة اختلال التوازن ، ومرد هذه المفاضلة هو احتواء مرحلة التفاوض لجميع مراحل حياة عقد الاستثمار الدولي بداية من المرحلة السابقة لإبرامه وصولا إلى تنفيذه مما يسهم إسهاما بالغا في كون هذه المرحلة تكون آلية فعالة في مجابهة أي خطر يهدد الأمن التعاقدي لعقد الاستثمار الدولي أو يكون سبب في اختلال The negotiation phase is a modern technical stage that gives rise to international nodal practices in dealing with the imbalance in international investment contracts. It shows flexibility in treating any imbalance that threatens the security of the contract. This gives it an advantage in international investment contracts, despite the existence of other legal techniques that provide solutions to the imbalance problem. This trade-off is due to the fact that the negotiation phase contains all phases of the international investment contract's life from its pre-conclusion stage to its implementation, which greatly contributes to the fact that it is an effective mechanism for countering any threat to the contractual security or imbalance of the international investment contract.
