عقد إيجار الأراضي الوقفية الفلاحية بين مقتضيات النص و ضرورة التفعيل للإستثمار – دراسة حالة في ضوء المرسوم التنفيذي14/70 –

Résumé: ملخص: يخضع عقد إيجار الأراضي الوقفية المخصّصة للفلاحة الموجه للاستثمار إلى أحكام المرسوم التنفيذي 14-70 المؤرخ في 10فبراير 2014 يحدد شروط و كيفياته التي تُسهل من إجراءات الإبرام إما عن طريق الميزاد العلني كقاعدة عامة أو بالتراضي إستثناءا وفق شروط خاصة كما يبين كيفية تنفيذ العقد وكل ما يرتبه من آثار في مواجهة الأطراف المتعاقدة بهدف تنمية وضمان حسن استغلالها. لتبقى كيفية تفعيله وإنجازه ميدانيا مقبولة ومحدودة تتطلب إعادة مراجعة . Abstract: The lease contract of endowments lands allocated for agriculture directed for investment is subjeالوقف;ct to the provisions of Executive Decree 14-70 dated February 10, 2014, which determines the terms and methods that facilitate the conclusion procedures either by public auction as a rule or by mutual consent as an exception according to special conditions. It also shows how to implement the contract and all the effects it entails in the face of the contracting parties with the aim of developing and ensuring its proper exploitation. The method of activating and implementing it in the field remains acceptable and limited and requires re-review.
