ضمانات الاستثمار الأجنبي طبقا لأحكام القانون رقم 16-09

Résumé: بهدف تشجيع الاستثمار الأجنبي عملت الجزائر على تقديم تحفيزات وميزات وضمانات مهمة لكل مستثمر أجنبي يسعى للاستثمار فيها، هذه الضمانات تنوعت ما بين ضمانات قانونية نصت عليها القوانين الوطنية، ومنها ضمانات اتفاقية نصت عليها الاتفاقيات المبرمة ما بين الحكومة الجزائرية والدول الأخرى، كما أرفقت الجزائر هذه الضمانات وفي إطار سعيها لتشجيع الاستثمار الأجنبي بإصلاحات عديدة في ميادين كثيرة وذلك منذ بداية التسعينات إلى غاية يومنا هذا، وعلى الرغم من هذه الإصلاحات والتحفيزات والضمانات التي سطرتها الجزائر لتحقيق أكبر قدر ممكن من الاستثمار الأجنبي إلا أن نسبة تدفق الاستثمارات الأجنبية المباشرة ما زالت ضعيفة مقارنة بالدول الأخرى. With the aim of encouraging foreign investment, Algeria has worked to provide important incentives, advantages and guarantees for every foreign investor seeking to invest in them. These guarantees varied between legal guarantees stipulated in national laws, including agreement guarantees stipulated in the agreements concluded between the Algerian government and other countries. Algeria also attached these guarantees. As part of its endeavor to encourage foreign investment through many reforms in many fields, since the beginning of the nineties until the present day, and despite these reforms, incentives and guarantees that Algeria has put in place to achieve the largest possible amount of foreign investment, the proportion of the flow of foreign direct investment is still weak compared to other countries
