الفساد الوظيفي في مجال الصفقات العمومية (جريمة منح إمتيازات غير مبررة أنموذجاً)

Résumé: الملخص: تعتبر الصفقات العمومية بؤرة للفساد ومحلاً للجرائم الواقعة على الأموال العامة والتي من أبرزها نجد ما يعرف بمنح إمتياز غير مبرر، ورغبة من المشرع الجزائري للحد من هذه الجريمة ومكافحتها تم إلغاؤها من قانون العقوبات والتنصيص عليها في القانون المتعلق بالوقاية من الفساد ومكافحته قصد تعزيز الحماية الجزائية للصفقات العمومية وضمان نزاهتها وشفافيتها عند عملية الإبرام بتبيان الأركان التي تقوم عليها هذه الجريمة والعقوبات المقررة لها. ومن خلال هذه الدراسة سيتم تسليط الضوء على أكثر الجرائم شيوعاً في مجال الصفقات العمومية عن طريق تبيان النظام القانوني لجريمة منح إمتياز غير مبرر. Abstract: Public transactions are considered a focal point for corruption and a favorable place for crimes against public funds, the most prominent of which is what is known as granting an unjustified concession. To combat and limit this crime the Algerian legislature endeavors has abolished it from the penal code and stipulated in the law related to preventing and combating corruption in order to enhance the penal protection of general transactions and ensuring their integrity and transparency during the conclusion process by clarifying the pillars on which this crime is based and the penalties prescribed for it. Through this study, light will be shed on the most common crimes in the field of public procurement, by clarifying the legal system for the crime of granting an unjustified privilege.
