المنازعات الانتخابية في انتخابات المجالس المحلية وفق القانون العضوي 16/10 المؤرّخ 25/08/2016
Résumé: العملية الانتخابية هي مجال للتنافس بين ثلاث أطراف أساسية هي : الناخب ، المرشح الإدارة وهذا هو الذي يمثل مجال المنازعات الانتخابية . وعلى هذا الأساس تناولت هذه الدراسة موضوع المنازعات الانتخابية المتعلقة بالانتخابات المحلية في ظل القانون العضوي 16/10 مرتكزة على تحليل القواعد المنظمة لحماية الحق الانتخابي والبحث في النظام القانوني الذي يحكم الطعون الانتخابية ودور الهيئات القضائية العادية والإدارية في حل المنازعات الانتخابية في جميع مراحل العملية الانتخابية. هذه العملية المتكونة من مرحلتين : مرحلة تحضيرية مرتبطة بالقوائم الانتخابية وإعداد مكاتب التصويت و الترشيح. The electoral process is a field of competition between three main parties: the voter, the candidate, the administration, and this is the field of electoral disputes. On this basis, the study dealt with the issue of electoral disputes related to local elections under Organic Law 16/10, based on an analysis of the rules governing the protection of the right to vote and research in the legal system governing electoral appeals and the role of ordinary and administrative judicial bodies in resolving electoral disputes at all stages of the electoral process. This process consists of two stages: a preparatory stage linked to electoral lists and the preparation of polling and nomination offices
