أي وجود للمسؤولية المهنية لأصحاب المهن الحرة في إطار المنظمات المهنية؟ (دراسة لبعض النماذج)

Résumé: ملخص: تعتبر المنظمات المهنية أشخاصا من القانون الخاص مكلفة بإدارة وتسيير الأمور المتعلقة بالمهن الحرة كمهنة الطبيب، المحامي، الموثق، المحضر القضائي، محافظ البيع بالمزايدة، المترجم-الترجمان الرسمي، المهندس المعماري. وتهدف هذه الدراسة إلى محاولة الكشف عن الإطار القانوني الذي يحكم المسؤولية المهنية لأصحاب المهن الحرة في إطار المنظمات المهنية. ومن بين النتائج الهامّة المتوصل إليها أن الأشخاص المهنيين يخضعون لأحكام المسؤولية المهنية المكرّسة في القوانين التأسيسية للمهن التابعة لهم وفي الأنظمة الداخلية التي يعدّونها على مستوى المنظمات المهنية. وبناء على ذلك، توصلنا إلى ضرورة العمل قدر الإمكان على توحيد نظام المسؤولية المهنية لمختلف المهن الحرة مع الأخذ بعين الاعتبار بخصوصية كل مهنة وتعزيز استقلالية المنظمات المهنية لتأدية مهامها على أكمل وجه. Professional orders are national professional organisations (doctors, lawyers, notaries, bailiffs, auctioneers, official translators and interpreters, chartered accountants, auditors and architects). The purpose of this study is to take stock of the legal framework governing professionals within professional orders. Among the conclusions drawn, it should be noted that professional liability is governed by the texts establishing the professional orders and by the internal regulations drawn up by the professionals themselves. Finally, it is necessary to seek a unified disciplinary law applicable to the various professions, obviously taking into account the specific features of each profession. As for the autonomy of professional organisations, this appears to be a fundamental need if they are to be able to carry out their missions in compliance with the rules of the art.
