القواعد الفقهية وأثرها في معرفة حكم النازلة

Résumé: لا تقف القاعدة الفقهية عند حد بيانها لحكم شرعي فحسب، بل تعين في معرفة أحكام النوازل المختلفة على حسب طبيعة القاعدة وأصولها، فقد جمعت القاعدة الفقهية أحكام الفقه الإسلامي، ومروتنها تساعد بشكل أو بآخر في تطوير الحكم الشرعي المتعلق بنازلة معاصرة، وموازنته على حسب الثابت فقها، وانطلاقا من هذا تجتهد هذه الدراسة في تحديد العلاقات القائمة بين النازلة والقاعدة الفقهية بما شملته من خصائص تنتقل من الواقعية إلى الكلية abstract A Jurisprudential rule does not stop only on its statement for a legitimate rule , but also it helps to know the verdict on different descendents according to the nature of the rule and its assets . The maxim had already compiled the provisions of the Islamic jurisprudence , And its flexibility helps in many ways in the development of the Islamic ruling on contemporary descendent ; balanced with the jurisprudentially constant . Proceeding from this , this study works so hard to determine the relationships between the descendent and the maxim ; including characters transferred from the realism to the entirety .
