المساعدة القضائية كآلية دستورية لحماية المرأة المعنفة

Résumé: تعد المساعدة القضائية آلية لتدعيم حق المواطن في المساواة أمام القضاء خاصة وأن التكاليف القضائية مكلفة لبعض الفئات، وقد أقره المشرع الجزائري كحق دستوري بموجب التعديل الدستوري لسنة 2016، غير أن هذا الحق خاص بفئات محددة قانونا. وفي إطار دعم سياسة الدولة الجزائرية في حماية المرأة من جميع أشكال العنف وصيانة حقوقها وعدم ضياعها بسبب العجز المالي، أقر المشرع في التعديل الدستوري لسنة 2020 بحقها في الاستفادة من المساعدة القضائية. Legal aid serves as a mechanism to reinforce citizens' right to equality before the judiciary, particularly given the costly nature of legal proceedings for certain segments of society. The Algerian legislature enshrined this as a constitutional right through the constitutional amendment of 2016, albeit restricted to specific legally defined groups. Within the framework of supporting the Algerian state's policy to safeguard women from all forms of violence, preserve their rights, and prevent their deprivation due to financial constraints, the legislature, in the constitutional amendment of 2020, granted them the entitlement to access legal aid.
