الرقابة القضائية على دستورية القوانين كآلية لحماية الحريات العامة - الدستور الجزائري أنموذجاً-

Résumé: تعالج هذه الدراسة موضوع الرقابة القضائية على دستورية القوانين بصفة عامة و في الجزائر على وجه الخصوص، وتركز على دور القضاء في هذا الإطار، حيث تسلط الضوء على دور القضاء في ترسيخ مدى دستورية القوانين الصادرة عن الهيئة التشريعية والهيئة التنفيذية، ولا يخفى علينا أن مهمة القضاء هي الفصل في المنازعات طبقاً لهذه القوانين، والتي يجب أن تتوافق مع نصوص الدستور باعتباره القانون الأعلى في الدولة. وسنبرز من خلال هذه الدراسة أشكال الرقابة القضائية، فهي لا تتخذ شكلاً مباشراً وإنما تتم بطرق معينة وهي: - الرقابة القضائية عن طريق الدعوى الأصلية. - الرقابة القضائية عن طريق الدفع. وتختلف الدول في الأخذ بهذه الرقابة حسب طبيعة النظام فيها بما في ذلك الجزائر، فما مدى تفعيل المشرع الجزائري لهذا النوع من الرقابة ؟. This study deals with the judicial review of the constitutionality of laws in general and in Algeria in particular. It focuses on the role of the judiciary in this regard, highlighting the role of the judiciary in enhancing the constitutionality of the laws issued by the legislature and the executive body. It doesn't hide on us that the task of the judiciary is to separate in Disputes accordance with these laws, which must be compatible with the provisions of the Constitution as the supreme law in the state. We will highlight through this study forms of judicial control, they do not take a direct form, but are carried out in certain ways, perhaps the most important: - Judicial control through the original case. - Judicial control through payment. The countries differ in taking this control according to the nature of the system in it, including Algeria, where we will look at to consider taking the Algerian legislator this kind of censorship?
