Résumé: The electroniques contract is considerd one of the must important means of electronic contracting it has characteristies that distiguish it form contracts concluded through traditionnel means however. these characteristies is raise many questions regading the possibility understanding the proof of these contracts is that the first law in this redard was the UNCITRAL MODEL LAW concerning electronic commerce ussed by the united nations in 1996. However the pricipale freedon to choose it as a means of expressing theur will in line with the general theory of the contracts and the will to be bound and that it is with in the frime work of the electronic contracts it raises a lot of confusion and ambiguinity especially with regard to identifying this category the consomater is considered the wealeest party in the contracts.
