الوكالة كآلية لإدارة شركات التّأمين التّكافلي في التّشريع الجزائري .

Résumé: إنّ إدارة وتسيير شركات التأمين التّكافلي وفق التّشريع الجزائري من خلال إدارة الصّندوق التّكافلي وفق صيغة الوكالة وكذا المضاربة. فالوكالة هي عقد بين حملة الوثائق وشركة التأمين التكافلي بهدف تسيير صندوق المشتركين من خلال إدارة أموال التأمين، فتسيير شركات التأمين التكافلي قد تكون بصيغة الوكالة بدون أجر، أو الوكالة بأجر، فالمُشَرّع الجزائري أخذ بالوكالة بأجر، كونها تتوافق وأحكام الشّريعة الإسلامية، كما نصّ المشرّع إلى الوكالة المختلطة وكالة ومضاربة. فالعلاقة التّعاقدية وفق الوكالة بأجر كون هذه الأخير يكون فيه الأجر معلوما ومحددا لمسيري الشّركة وفق هذه الصّيغة، وعليه فإن الوكالة كآلية لتسيير وإدارة الشّركة فقط، فلا يتحمّلون الخسائر في حالة خسارة الشركة، كما أنّهم لا يمكنهم الحصول على الفائض التّأميني. فالعلاقة بين المساهمين وشركات التأمين التّكافلي تتمثل في أنّ حَمَلَة الوثائق يمكنهم إدارة وتسيير العمليات التأمينية لصندوق التكافلي، فهم يقومون بهذا العمل مقابل الحصول على أجر معلوم ومحدود، فالعلاقة التي تربط المساهمين بالشركة هو عقد الوكالة، فهذا العقد يربطهم بالشركة فقط، وليس بحَمَلَة الوثائق، فتتمثل مهمتهم في التّسيير وإدارة أعمال الشّركة من الجانب المحاسبي والمالي، من خلال دفع التعويضات، ومطالبة حَمَلَة الوثائق بدفع الأقساط، ودفع التعويضات وإدارة المخاطر. The administration and management of tontine insurance companies based on the Algerian legislation is achieved through the management of the mutual Fund according to the agency formula as well as the speculation. The agency is a contract between policyholders and the Tontine insurance company with the aim of managing the agents’ fund through the management of insurance funds. Moreover، the management of tontine insurance companies can be in the form of an agency without remuneration, or paid one. The Algerian legislator dealt with paid agency, in accordance with the provisions of Islamic Sharia, as the legislator stipulated to mixed agency and speculation. On this basis, the contractual relationship depends on the paid agency since the latter is the wage and is known and specified for the company’s managers according to this formula, and therefore the agency is a mechanism for running and managing the company, in order to rid themselves of the losses in the event of the company’s loss, but they cannot obtain the insurance surplus. Furthermore, the relationship between shareholders and Takaful insurance companies is that policyholders can administer and manage the insurance operations of the tontine Fund, so they do this work in return for a known and limited fee. Their mission is to manage and administer the company's business from the accounting and financial side, by paying compensation, asking policyholders to pay premiums, paying compensation and managing risks.
