الدراسات الفقهية المقارنة كآلية لتقليل الخلاف الفقهي. -دراسة في الأهمية والمنهج-

Résumé: يتناول هذا البحث موضوع الفقه المقارن-أو ما يعرف بالدراسات الفقهية المقارنة أو الخلاف العالي- من حيث مفهومه وأهميته البارزة في تقليل الخلاف الفقهي في الفروع والتقريب بين المذاهب، وهذا بنبذ التعصب والإشادة بالحق بطريقة موضوعية من خلال منهج صحيح يتمثل في عرض عناصره وأدواته بتسلسل ودقة، بدأ بتصوير المسألة، فتحرير محل النزاع، ثم ذكر أقوال المسألة وأدلتها ومناقشتها، ثم ترجيح الدليل الذي يكون أقرب للحق، ثم ذكر أسباب الاختلاف، وأخيرا ثمرة الخلاف. This research deals with comparative jurisprudence-or comparative jurisprudence studies, or high disagreement-,in terms of its concept, and its importace in reducing the doctrinal dispute, and the approximation between the jurisprudential schools of thought, this is to reject fanaticism, and follow the truth in objectiv way, through a correct approach that is to present ist elements and tools with sequence and precision, starting from the image of the doctrinal issue , then editing the subject of the dispute, then mentioning the sayings andevidence of the issue and discussing it, then weighing the evidence that is closer to truth, then mentioning the reasons for the differnce, and finall the fruit of the desagreement.
