النوازل الفقهية الطبية

Résumé: الملخص: تهدف هذه الأطروحة إلى بيان الأصول الفقهية للمستجدّات الطّبّيّة وصولا إلى معرفة أحكامها الشّرعية في ضوء مقاصد الشّريعة، وتركز أساسًا على العلاجات الحديثة معتمدة في ذلك على المنهج الوصفي والمنهج الاستقرائي، وخلصت الأطروحة إلى عدّة نتائج أهمّها: ضرورة مراعاة ضوابط الاستدلال في اعتبار كلّ أصل فقهي حال استنباط الأحكام الشرعية للنوازل الطبية المتفق على جوازها تظهر جليّة في كلّ ما لم يكن أصل سد الذرائع معتمدا لدى الباحثين، مثل: التبرع بجزء من الأعضاء المتجددة، ووجود الضرورة في مسائل التشريح، الجراحة الطبية والبنوك الطبية. النوازل الفقهية الطبية المختلف في حكمها منشأها تنوع الأدلة، وتجاذبها في الدلالة، واعتبار المصلحة من عدمها لدى الباحثين المعاصرين، وأهمها: التبرع بالأعضاء، التشريح ذو المصلحة الراجحة، عملية رتق غشاء البكارة وجراحة تحويل الخنثى الحقيقي وما يترتب على بعض هذه المسائل من إنشاء بنوك طبّية. النوازل الفقهية الطبية المتفق على عدم جوازها يُعتدّ فيها بأصل سد الذرائع، ووجود الضّرر في العلاج لدى الباحثين، مثل: زراعة الأعضاء المفضية إلى الوفاة، أو إلى انتقال الصفات الوراثية، وما لا فائدة شرعية منه في مسائل الجراحة الطبية والاستنساخ وطرائق الاستيلاد. تناسب المقاصد الشرعية وجودا وعدما، مع الأصول الفقهية المعتمدة، والأحكام الشّرعية للمستجدّات الطّبّيّة. Abstract : This thesis aims to clarify the jurisprudential principles of medical developments in order to know their legal rulings in the light of the purposes of Sharia, and focuses mainly on modern treatments, relying on the descriptive and inductive approach, and the thesis concluded with several results, the most important of which are: The necessity of observing the controls of inference in considering each jurisprudential origin when deducing legal rulings for medical updates. The medical developments that are agreed upon on their permissibility are evident in everything that the origin of blocking the pretexts is not supported by researchers, such as: donating part of the organs. and the necessity in matters of anatomy, medical surgery and medical banks. The various medical jurisprudence updates in their ruling stem from the diversity of evidence, their attraction in significance, and the consideration of the interest among contemporary researchers, the most important of which are: organ donation, autopsy, hymen repair surgery and transsexual surgery, and the consequences of some of these issues in establishing medical banks . The medical jurisprudential updates agreed upon that it is not permissible to take into account the principle of blocking the pretexts, and the presence of harm in treatment among researchers, such as: organ transplantation that leads to death, or to the transmission of genetic traits, and what is not legitimately useful in matters of medical surgery, cloning and methods of reproduction. Legitimate purposes, whether or not, are compatible with the approved jurisprudential principles, and the legal rulings for medical developments.
