Résumé: ملخص: تتناول هذه الدراسة الكشف عن الاختيارات الفقهية في باب المعاملات المالية لعَلم من أعلام المدرسة البغدادية المالكية وهو القاضي ابن القصار، وقد اشتمل الهيكل العام للدراسة عِلاوة على المقدمة والخاتمة؛ على مبحثين تحت كل مبحث مطلبان، ذكرت في المبحث الأول ترجمة لابن القصار وعرضا لآثاره العلمية، وفي المبحث الثاني تطرقت إلى بيان معنى الاختيارات الفقهية ثم عرضا لاختيارات ابن القصار الفقهية في مختلف أبواب المعاملات المالية، وفي الأخير خلُصت الدراسة إلى أن ابن القصار من الفقهاء المجتهدين في المذهب المالكي، ومن خِيرة ما أنجبته المدرسة البغدادية المالكية، وقد استطاع بلوغ مرتبة مكنته من الترجيح والاختيار بين الأقوال، وهذا لا يتأتى إلا لمن اتسعت معارفه، وأحاط بأصول وفروع المذاهب ومقاصد الشارع، لذلك نالت اختياراته اهتماما ومكانة في المذهب المالكي وباقي المذاهب الأخرى. الكلمات المفتاحية: الاختيارات، ابن القصار، الفقه، المعاملات، المال. Abstract: This study aims to uncover the jurisprudential choices in the charter of financial transactions of a prominent scholar from the Baghdadi Maliki school, namely Qadi ibn al-qassar. In addition to the introduction and conclusion, the general structure of the study includes two sections, each with two subsections. The first section presents a biography of ibn al-qassar and an overview of his scholarly works. The second section defines the concept of jurisprudential choices and then presents ibn al-qassar's jurisprudential choices in various chapters of financial transactions. Finally, the study concludes that ibn al-qassar in one of the mujtahids of the maliki school and one of the finest scholars produced by the Baghdadi maliki school. He was able to reach a level that enabled him to give preference and choose between an opinion, which is possible for those who have extensive knowledge and a comprehensive understanding of the principles and branches of the various schools of thought and the objectives of Islamic law.
