دور أجهزة الإستثمار في الرقابة السابقة على الإستثمار الأجنبي

Résumé: عمد المشرع الجزائري في سبيل تنظيم مجال الإستثمار وخصوصا الإستثمار الأجنبي إلى إنشاء أجهزة مكلفة بالإستثمار بموجب الأمر 01- 03 المتعلق بتطوير الإستثمار الملغى جزئيا والقانون 16-09 المتعلق بترقية الإستثمار، تتمثل في الوكالة الوطنية لتطوير الإستثمار والمجلس الوطني للإستثمار، تقوم بمباشرة رقابة سابقة على الإستثمار الأجنبي، تبرز من خلال ما تقوم به الوكالة من توجيه وترشيد للمستثمر الأجنبي، ومتابعتها لعملية إنجاز المشروع الإستثماري، بالإضافة إلى ما يقوم به المجلس الوطني للإستثمار من منح الموافقة المسبقة لبعض الإستثمارات حتى تستفيد من المزايا وتذليل لبعض الصعوبات التي يواجهها المستثمر الأجنبي. وتوصلت الدراسة إلى أن المشرع في ظل القانون 16-09 المتعلق بترقية الإستثمار خفف من الرقابة التي تقوم بها أجهزة الإستثمار رغبة منه في جذب الإستثمارات الأجنبية، لكنه رغم ذلك لم يلق إقبالا من المستثمرين الأجانب نظرا للنقائص الموجودة في قوانين الإستثمار In order to regulate investment, in particular foreign investment, the Algerian legislator has established bodies responsible for investment in accordance with Ordinance No. 01-03 on the development of partially cancelled investment and Act No. 16.09 on promotion of investment, consisting of the National Agency for Investment Development and the National Investment Council, which carry out prior monitoring of foreign investment, which is reflected in the Agency'guidance and rationalization of foreign investors and its follow-up on the completion of the investment project. The study found that, under the 16-09 Act on Promotion of Investment, the legislator relaxed the control of investment agencies in order to attract foreign investment, but nevertheless did not find acceptance from foreign investors due to shortcomings in the investment laws.
