العقوبات المقررة للخطأ المهني ما بين قانون الوظيفة العمومية وقانون العمل -دراسة في المفهوم-

Résumé: يعتبر التأديب ضرورة ملـحة في أية دولة لما له من تأثير عـلى النظام السياسي والاقتصادي والاجتماعي بها، وتبرز فعاليته أكثر بالنظر إلى مصدر السلطة التأديبية المتمثلة في العلاقة الرئاسية التي يخضع لها الموظف المرؤوس للإدارة من جهة و كذا علاقة التبعية التي يخضع لها العامل لصاحب العمل من جهة أخرى منحت قوانين الوظيفة العمومية حقوقا وضمانات للموظف المتابع في مواجهة السلطة التأديبية التي لا بد منها لتأمين عدالة العقوبة التأديبية وبعث الطمأنينة في نفسية الموظف فإن العقوبة التأديبية محددة على سبيل الحصر و لا يمكن للسلطة التأديبية أن تختار العقوبة التي تريد توقعيها إلا من بين العقوبات التي حددها القانون، النظام الداخلي أو الاتفاقية الجماعية إن وجدت، و إلا كان قرار العقوبة باطلا . The disciplinary system remains an urgent necessity in any country because of its impact on the political, economic and social system within it, and its effectiveness is more evident given the source of the disciplinary power represented in the presidential relationship to which the subordinate employee is subject to management on the one hand, and the dependency relationship to which the worker is subject to the employer on the other hand. Public employment laws grant rights and guarantees to the next employee facing the disciplinary authority necessary to guarantee the fairness of the disciplinary sanction and to reassure the employee's psyche, the disciplinary sanction is determined exclusively and the disciplinary authority can only choose the sanction you wish to expect from the sanctions provided for by law, regulations or collective agreement, if applicable, otherwise the sanction decision is void
