Résumé: نظرا لما يطرحه إنهاء عقد الشغل غير محدد المدة في التشريع المغربي بالإرادة المنفردة لطرفيه من إشكالات فإن مجال هذه الدراسة يمتد لدراسة عقد الشغل غير محدد المدة والتي يشترك فيها مع عقد الشغل محدد المدة، كاتفاق الطرفين والإبطال واستحالة التنفيذ وغيرها من أسباب انتهاء العقود على اختلاف أنواعها فالمشرع المغربي من خلال مدونة الشغل يحاول إعطاء حياة أطول لعقد الشغل حتى يحقق الأهداف المتوخاة منه، وسد الباب أمام علاقات الشغل المؤقتة التي لا تؤدي في غالب الأحيان إلى الاستقرار الاجتماعي المتمثل في حماية أطراف العلاقة الثلاثية المتمثلة في الأجير كطاقة للإنتاج والمشغل كفاعل اقتصادي واجتماعي داخل اقتصاد وطني متماسك وقوي، والدور الهام للقضاء في تطبيق المقتضيات الحمائية تطبيقا سليما وذلك لتحقيق التوازن في علاقات الشغل لخدمة مصلحة المقاولة والأجير.
