التعسف في استعمال الحق في القوانين العقارية

Résumé: تقوم فكرة التعسف في استعمال الحق في القوانين العقارية على ضرورة تصرف الفرد في ملكه بشكل لا ينحرف به عن الوظيفة الاجتماعية للحق. واذا ما حصل ذلك الانحراف عد مخطئ مجبرا على تعويض الضرر. وتكمن اهمية الموضوع في تسليط الضوء على المعايير والضوابط التي يتم التمييز من خلالها بين الافعال التي تعتبر مشروعة، عن غيرها من التصرفات التي تعد تعسف في استعمال حق الملكية العقارية، وبيان نطاقه، صوره وتطبيقاته، والاثار المترتبة عنه The idea of arbitrariness in the use of the right in real estate laws is based on the need for the individual to act in his property in a manner that does not deviate from the social function of the right. .
