الصلح والتحكيم بين الزوجين والعلاقة بينهما في القانون الجزائري

Résumé: الصلح والتحكيم من الوسائل الشرعية والقانونية لحل النزاعات بين الزوجين ومعالجة المشاكل الأسرية، وقد أوجب المشرع الجزائري على قاضي شؤون الأسرة القيام بمحاولات الصلح قبل الحكم بالطلاق دون أن تتجاوز ثلاثة أشهر ابتداء من تاريخ رفع الدعوى، كما يتوجب على القاضي تعيين حكمين للتوفيق بين الزوجين إذا اشتد الخصام ولم يثبت الضرر، ويقدم الحكمان تقريرا عن مهمتهما في أجل شهرين، فكلاهما إجراء تمهيدي قبل الحكم بالطلاق، وفي كليهما إذا تراضى الزوجان على مواصلة الحياة الزوجية وجب إثبات ذلك بمحضر غير قابل للاستئناف. والقصد من الصلح والتحكيم هو التوفيق بين الزوجين والإصلاح بينهما وتأجيل الطلاق وإقناع الزوجين باستبعاده وتجاوز الخلاف. Arbitration and reconciliation are legitimate and legal means for resolving disputes between spouses and addressing family problems. The Algerian legislator has mandated that the family court judge attempt reconciliation before issuing a divorce judgment, with a maximum period of three months from the date the lawsuit is filed. Additionally, the judge must appoint two arbitrators to reconcile the spouses if the conflict intensifies and harm is not proven. These arbitrators must provide a report on their mission within two months, both serving as a preliminary step before divorce is pronounced. If the spouses agree to continue their marital life, this must be documented in a non-appealable record. The purpose of reconciliation and arbitration is to reconcile the spouses, resolve their issues, delay divorce, and convince the spouses to set aside their differences.
