التدابير القانونية للحدّ من فك الرابطة الزوجية
Résumé: تناولت هذه الدراسة وسيلة من وسائل تسوية النزاعات الأسرية ألا وهو الصلح ,حيث تطرقنا إلى مفهومه , ومشروعيته وحكمه وإلى أركانه في الفقه الإسلامي وقانون الأسرة الجزائري , كما تطرقنا إلى إجراءات الصلح في الفقه الإسلامي عند نشوز الزوجين وإلى إجراءاته في القانون الجزائري . كما تناولنا وسيلة اخرى من وسائل تسوية النزاعات الاسرية ألا وهو التحكيم وحيث تطرقنا إلى مفهومه , ومشروعيته وحكمه وإلى أركانه في الفقه الإسلامي وقانون الأسرة الجزائري , كما تطرقنا إلى الفرق بينهما (الصلح والتحكيم ) وإلى إجراءات التحكيم في الفقه الإسلامي عند شقاق الزوجين مع ذكر الأثار القانونية لعمل المحكمين . الكلمات المفتاحية : التسوية , النزاعات , الاجراءات , الصلح , التحكيم . Summary : This study dealt with one of the means of settling family disputes, which is reconciliation. We also discussed another means of settling family disputes, which is arbitration, where we touched on its concept, its legitimacy, its ruling and its pillars in Islamic jurisprudence and Algerian family law, as well as the difference between them (conciliation and arbitration) and arbitration procedures in Islamic jurisprudence when the spouses’ discord with mentioning the legal effects for the work of arbitrators.
