الآليات القانونية لمكافحة الفساد في مجال الصفقات العمومية في الجزائر

Résumé: يعتبر الفساد ظاهرة قديمة، قدم المجتمع الإنساني. ومع استفحال هذه الظاهرة في المجتمعات الحديثة، بسبب تشعّب وتعقّد ميادين الحياة السياسية والإقتصادية والإجتماعية، عملت الحكومات والمجتمعات على الحدّ منه بمختلف الوسائل المتاحة، بدءا بتحديد المجالات الأكثر عرضة لمخاطر الفساد، ثمّ وضع الآليات المناسبة للحد منه، ومن أهم تلك الآليات، هناك الآليات القانونية بشقّيها الوقائي والردعي. ومن خلال هذه الورقة البحثية، نحاول التعرّض لظاهرة الفساد وأسبابها في الجزائر، ثمّ التركيز على الفساد في أكثر المجالات خصبة، وهو ميدان الصفقات العمومية، وتحديد أهم الآليات القانونية التي وضعها المشرّع الجزائري للحدّ من الفساد، سواء كانت وقائية أو ردعية. وخلصنا إلى أنّ المشرّع الجزائري إستطاع في الجانب الوقائي وضع تدابير تضمن سلامة إجراءات إبرام الصفقات، مع بعض القصور الذي يكتنف تطبيق تلك التدابير، أما في الجانب الردعي، فهناك صعوبة في حصر السلوكيات المؤدية للفساد، وفق الآلية القانونية ، وهذا راجع بالأساس لتطور تلك السلوكيات. Abstract: Corruption is an old phenomenon. While the phenomenon is intensified in modern societies, because of the complexity of the political, economic and social spheres of life, governments and societies have reduced it in many ways, ranging from determining the most vulnerable areas to corruption, and then putting in place appropriate legal tools to reduce it. Whether preventative or dissuasive. In this article, we try to address the phenomenon of corruption in Algeria, then we focus on corruption in a most vulnerable area, it is the field of public procurement, and determine the legal tools set up by the Algerian legislator to reduce corruption, whether preventive or dissuasive. We concluded that the Algerian legislator was able to put in place, as a preventive measure, measures guaranteeing the integrity of public procurement procedures, with some shortcomings in the application of these measures, while on the dissuasive side, it is difficult to limit the behavior leading to corruption, due to the evolution of these behaviors.
