السيادة الوطنية في ظل مقاربة مسؤولية الحماية.

Résumé: ملخص: تعد فكرة السيادة الوطنية في الأنظمة القانونية الناظمة لشؤون و علاقات الدول الركن الأساس في بقاء واستقلال الدول، و من ثمّ فإن حريتها في تصرفاتها داخل إقليمها أو خارجها يكون بناءا على قواعد القانون الدولي الثابتة، غير أن هذا المفهوم كقيمة و مبدأ استقر عليه التعامل الدولي اهتزّ كثيرا و خصوصا بعد تعاظم الاهتمام الدولي بفكرة حقوق الإنسان، الأمر الذي أدى بالموازاة إلى نضج مقاربة الحماية الإنسانية لهذه الحقوق، وذلك تبعا لما يسمى بالنظام الدولي لحقوق الإنسان، و ما تترتب عنه من بروز لفكرة المسؤولية الدولية لحماية هذه القيم المرتبطة أساسا بالإنسان، الشيء الذي أعاد النظر في فكرة السيادة من جديد وفق أطر و مفاهيم تبعا لأولوية حماية حقوق الإنسان التي أصبحت لها قيمة دولية. : Abstract The idea of national sovereignty in the legal systems governing the affairs and relations of states is the main element in the survival of states independence; and therefore their freedom to act within or outside their territory is based on the established rules of international law .however this concept as a value and a principle on which international action has been based is very shaker ;especially after the international interest in the idea of human rights has grown which led to parallelism to maturity of the human protection approach of these rights. And this in accordance with so called international human rights system; and the emergence of the idea of international responsibility for the protection of these values which are primarily related to man; which has re examined the idea of sovereignty in accordance with the frameworks and concepts according to the priority of the protection of human rights.
