السوار الإلكتروني ومساسه بالحياة الخاصة للمتهم بمنظور اللأمر15-02

Résumé: الملخص: لقد جاء نص الأمر15-02 المعدل لقانون الإجراءات الجزائية ينص على المراقبة الإلكترونية (تقنية السوار الإلكتروني)كنوع من أنواع المراقبة القضائية، وإن من الجوانب السلبية لهذه المراقبة تشكل خطرا ومساسا على ما تبقى للمحكوم عليه( المتهم) من حق في حياته الخاصة ومنها حرمة المسكن وحرمة الجسد وسلامته. فهذين الحقين تمسهما تقنية السوار الإلكتروني مما يجعلها تتعارض مع مبدأ عدم الإعتداء على حرمة المسكن في الحق الاول، والثاني يتعارض مع ما يترتب على وضع الجهاز الإلكتروني على الجسد من آثار صحية سيئة، إضافة إلى الآثار النفسية الناتجة عن شعور الخاضع للرقابة الإلكترونية من خلال نظرة المجتمع إليه. Abstract : The amended text order N° 02-15, related to the criminal procedure code, has been included the electronic monitoring (Electronic bracelet technique) as a sort of the judicial control types. One of the negative aspects of this monitoring is that it poses threat and encroachment upon what is left of rights for the convicted person (accuser) for his private life, including inviolability of home and body and safety. The electronic bracelet technique that affecting those both rights is inconsistent with the principle of non-aggression on the inviolability of home in the first right and incompatible with the consequences of the bad health effects resulting from the used electronic device on the body in the second right in addition to the psychological effects of the controlled person resulting from the society’s viewpoint.
