الرقابة على دستورية القوانين عن طريق آلية الدفع بعدم الدستورية: قراءة في ظل دستور 2020 والقانون العضوي 22-19

Résumé: إن المؤسس الدستوري الجزائري ولضمان مبدأ سمو الدستور وتكريس دولة القانون، استحدث بموجب التعديل الدستوري لسنة 2016 آلية أخرى للرقابة على دستورية القوانين مكفولة لأطراف الدعوى أمام القضاء، وهي الآلية التي تم تعزيزها في دستور 2020، حيث يتسنى لهم إثارة الدفع بعدم الدستورية ضد أي نص تشريعي أو تنظيمي ينتهك الحقوق والحريات التي يكفلها الدستور شريطة أن يتوقف عليه مآل النزاع ، ليكتمل النظام القانوني لهذه الآلية بصدور القانون العضوي 22-19 المحدد لإجراءات وكيفيات الإخطار والإحالة المتبعة أمام المحكمة الدستورية، لتشهد السنوات الأخيرة منذ نهاية 1920 ثمار هذه الآلية بفصل المجلس الدستوري)سابقا( والمحكمة الدستورية )حاليا( لعدة دفوع بعدم الدستورية. The Algerian constitutional founder, and to guarantee the principle of the supremacy of the constitution and the consolidation of the rule of law, introduced, according to the constitutional amendment of 2016, another mechanism for monitoring the constitutionality of laws that is guaranteed to the parties to the lawsuit before the judiciary. The legislative or regulatory framework on which the outcome of the dispute depends violates the rights and freedoms guaranteed by the Constitution. The legal system for this mechanism was completed with the issuance of Organic Law 19-22 that specified the procedures and modalities for notification and referral before the Constitutional Court, so that the last years since the end of 2019 witnessed the fruits of this mechanism with the issuance of several decisions by the Council Constitutional Court (formerly) and the Constitutional Court (currently).
