حماية الشاهد بين الثاب والمتغير في القانون الجزائري

Résumé: - أولت جل التشريعات الجنائية الدولية اهتماما بالغا بموضوع حماية الشاهد، استنادا للدور الأساسي الذي يقدمه في كشف الحقيقة وحسم الدعوى الجنائية،فوجود نظام فعال لحماية الشهود يعد من أهم وسائل تضييق الخناق على بعض الجرائم التي تمتاز بالتستر وصعوبة الكشف عن مرتكبيها والحديث هنا عن جرائم الرشوة ، استغلال النفوذ ، الاختلاس ، الغدر ،غسل الأموال وغيرها من جرائم الفساد وجرائم الإرهاب والعصابات الإجرامية المنظمة، كما يساهم في توفير بيئة آمنة، تحفز الشاهد التقدم إلى الجهات القضائية للإدلاء بشهادته. - هذه الحماية كرسها المشرع الجزائري من خلال نصوصه القانونية العامة والمستحدثة منها بموجب القانون 15-02 هذا الأخير الذي أحدث قفزة نوعية في المنظومة القانونية،حيث ساهمت هذه التعديلات في اتساع مجال حماية الجنائية للشاهد مقارنة بالأحكام السابقة. - Most of the international criminal legislation has paid great attention to the issue of witness protection, based on its fundamental role in uncovering the Ruth and resolving the criminal case. Exploitation of influence, embezzlement, treachery, money laundering, etc. (corruption offenses), terrorisms crimes and organized criminal gangs, and contributes to the provision of a safe environment, motivate the witness to apply to the judicial bodies to testify. - This protection was enshrined by the Algerian legislatorthroughits general legal texts and created by the Law 15-02, the latter which made a qualitative leap in the legal system, where several amendments have contributed to the widening of the criminal protection of the witness compared to the previous provisions.
