Résumé: تعد الأسرار التجارية من العناصر الرئيسية للمشاريع التجاريـة ، وخاصـة علـى المستوى الدولي حيث تعتبر المحور الأساسي في عمليات نقل التكنولوجيا، وقـد زاد الاهتمام بالأسرار التجارية بعد إنشاء منظمة التجارة العالمية، إذ تفضل الكثير مـن المنشـآت المنتجـة للتكنولوجيا الاحتفاظ باختراعاتها سرا وعدم الكشف عنها والاستفادة من الحماية التـي توفرهـا قوانين الأسرار التجارية. فأقر المشرع الجزائري نظاما قانونيا لحماية هذا النوع كتجسيد لمواد اتفاقية تريبس على المستوى الوطني من خلال إقراره لنوعين من الحماية وهي الحماية المدنية والحماية الجنائية، فما مدى فعالية دعوى المنافسة غير المشروعة كوسيلة قضائية لحماية المعلومات غير المفصح عنها في الجزائر؟ Trade secrets are one of the main elements of commercial projects, especially at the international level, where they are considered the main axis in technology transfers, and interest in trade secrets has increased after the establishment of the World Trade Organization, as many technology-producing enterprises prefer to keep their inventions secretly and not to disclose them and benefit from the protection provided by trade secret laws. The Algerian legislator approved a legal system to protect this type as an embodiment of the articles of the TRIPS Agreement at the national level through its approval of two types of protection, namely civil protection and criminal protection, so how effective is the unfair competition lawsuit as a judicial means to protect undisclosed information in Algeria?
