دعوى المنافسة غير المشروعة كآلية إجرائية لحماية المستهلك في التشريع الجزائري

Résumé: ملخص قد يتجاوز العون الإقتصادي حدود المنافسة المشروعة ويستعمل أساليب مخالفة للقانون والعادات والأعراف التجارية والإستقامة في المعاملات، فيتضرر من خلالها العون المنافس أو تتضرر رفاهية المستهلك أو بشكل أهم قد يتضرر الإقتصاد الوطني بشكل عام وهذا ما يمسى المنافسة غير المشروعة، الأمر الذي أدى لضرورة وجود آليات تحمى وتراقب الأسواق، وتمنع أي تجاوز سلوكي غير نظامي للأعوان الاقتصاديين في الأسواق. وبتالي هناك آليات قضائية لحماية المستهلك تتمثل في دعوى المنافسة غير المشروعة التي لها دور مزدوج الأول حمائي يتمثل في الحماية والتعويض في حالة وقوع الضرر، ودور وقائي يتمثل في وقف الأعمال غير المشروعة مستقبلا. Abstract The economic operator may exceed the limits of legitimate competition and use methods contrary to the law, commercial customs and honesty of transactions, This causes harm to the competitor, to the welfare of consumers, or more importantly, the national economy can be damaged. All this calls for unfair competition, This has led to the need for the existence of mechanisms that protect and monitor markets, and prevent any improper behaviour of economic actors in markets. Subsequently there is a mechanism of justice to protect consumers is reflected in unfair competition, it has a double role, the first protectionist role represented by protection and compensation in case of damage, and the second preventive measure to put an end to future unfair acts.
