الدور الوقائي والعلاجي للسياسة الجنائية

Résumé: تعتبر السياسة الجنائية الموجهة للمشرع هي تلك التي تحدد الجرائم والجزاءات المقررة لها في ضوء الغاية التي تستهدفها السياسة الجنائية، ويمثل هذه الصورة قانون العقوبات والقوانين المكملة له، أما السياسة الجنائية الموجهة للقضاء فهي التي تحدد إجراءات الخصومة الجزائية، ومدى سلطة القاضي في توقيع العقوبات المقررة لها، ويتم مزاولتها عند مباشرة الإجراءات الجزائية وآخرها إصدار الحكم، وتتعلق السياسة الجنائية الموجهة لسلطة التنفيذ بتحديد سلطات المؤسسة العقابية المكلفة بتنفيذ الجزاء والتدابير، ومدى رقابة السلطة القضائية على هذا التنفيذ، كما تحدد القواعد العامة المتعلقة بأنواع السجون ونظمها، وإجراءات تصنيف المجرمين وكيفية معاملتهم. ولا شك أن السياسة الجنائية تمتد لتشمل مختلف مناحي الحياة، والشق الوقائي منها على وجه الخصوص له فروع –ولو خفيت- في قطاعات شتى تنشد في نهاية الأمر تكوين الإنسان السوي الذي بدوره وبمجموع أمثاله ينتجون لنا الوطن الآمن. وقد ارتأينا أن بنيّن بأن السياسات الجنائية الموضوعة لمكافحة الجرائم والحد منها لا تعتمد فقط على النتائج التي تحصل بسبب وقوعها، وإنما لها جانب استباقي متمثل في اعتماد وإتباع أساليب تنفّر من الوقوع في الجريمة، إما بطريق الترهيب والزجر، أو بطريق التوعية الاجتماعية، وهي تعتمد في ذلك على مختلف الهيئات وتستعمل مختلف الروافد التي توصل إلى هذا الهدف وتحقق هذا التصور. The criminal policy directed at the legislator is the one that defines the crimes and the penalties prescribed for them in light of the purpose of the criminal policy, and this image is represented by the Penal Code and the laws that complement it. As for the criminal policy directed to the judiciary, it determines the procedures of criminal litigation, and the extent of the judge’s authority to impose the prescribed penalties It is practiced upon initiation of penal procedures, the latest of which is sentencing. The criminal policy directed at the enforcement authority is related to determining the powers of the penal institution charged with implementing the penalty and measures, and the extent of the judicial authority’s control over this implementation. It also defines the general rules related to prison types and systems, procedures for classifying criminals and how they are treated. There is no doubt that criminal policy extends to include various aspects of life, and the preventive part of it in particular has branches - albeit hidden - in various sectors that ultimately seek to form a normal human being who, in turn, with a group of his likes, produces for us a safe homeland. We have decided to show that the criminal policies designed to combat and reduce crimes do not depend only on the results that occur due to their occurrence, but rather have a proactive aspect represented in the adoption and adoption of methods that deter crime, either through intimidation and restraint, or through social awareness. That is on the various bodies and uses the various tributaries that reach this goal and achieve this perception.
