حدود ممارسة النشاط الإقتصادي في الجزائر The Limits Of The Economic Activity In Algeria

Résumé: مـلخـص: تعتبر حرية النشاط الاقتصادي من بين المفاهيم الحديثة المنصوص عليها قانونيا فأهمية هذه الحرية في المجال الاقتصادي دفع بالمشرع الجزائري إلى التحرك وتأطيرها قانونيا، من خلال استخدام العديد من المفاهيم كحرية: التجارة، الاستثمار، المنافسة، الاستيراد والتصدير...، فضلا عن تكريسها دستوريا منذ سنة 1996 إلى غاية اليوم، وفي إطار المحافظة على هذه الحرية وحمايتها تم إدراج مجموعة من القيود عليها منها ما يتعلق بالشخص الممارس للنشاط الاقتصادي ومنها ما يتعلق بالنشاط في حد ذاته. Abstract: Freedom of economic activity is one of the modern concepts stipulated by the law and its importance in the economic field has moved and motivated the Algerian legislator to regulate it legally, through the use of several concepts related to the economy such as the freedom of trade, investment, competition, import and export ..., in addition to its consecration in the constitution since 1996 until today. To this end, for the best preservation and protection of this freedom, a set of restrictions have been established relating to the person carrying out an economic activity or the activity itself.
