حق الأسير في ممارسة الشعائر الدينية

Résumé: لقد تناولت هذه الورقة البحثية موضوع "حق الأسير في ممارسة الشعائر الدينية في الفقه الإسلامي واتفاقية جنيف الثالثة1949"، وذلك للإجابة على إشكالية أحقية أسير الحرب في ممارسة شعائره الدينية دون تمييز بسبب إثني أو ديني أو لغوي أو عرقي، وذلك من خلال خطة ثنائية، مقسمة على مبحثين، في كل مبحث مطلبين: إذ عالج المبحث الأول منها الإطار المفاهيمي لحق أسير الحرب في ممارسة الشعائر الدينية، وتطرق المبحث الثاني فيها إلى حق تطبيقها في نصوص الفقه الإسلامي و مواد اتفاقية جنيف الثالثة 1949، وقد بينت الدراسة طبيعة حرية المعتقد وضماناته في الفقه الإسلامي واتفاقية جنيف الثالثة، ثم خلصت في الأخير إلى مجموعة من النتائج والتوصيات أهمها: أن حرية الإنسان لا تخول له المساس بحقوق غيره، خاصة إذا ما تعلق الأمر بحرية المعتقد، وأن ممارسة شعائره الدينية مقررة و مضمونة في الفقه الإسلامي ومختلف المواثيق الدولية: العالمية منها والإقليمية، وبناء على ما تقدم ذكره، فإن هناك ضرورة ملحة إلى تفعيل حق الأسير في ممارسة الشعائر الدينية تنظيرا وتطبيقا، وإشرافا ومراقبة ومتابعة، وذلك من خلال إنشاء هيئات أو مؤسسات تتابع النظر في الشكاوى المتعلقة بممارسة حرية الدين بكل حيادية ونزاهة. Abstract: the research paper addressed "The issue of Prisoner's Right to Practice Religious Rituals in Islamic Jurisprudence and the Third Geneva Convention of 1949" in order to answer the problem of the right of the prisoner of war to practice his religious rituals without discrimination on the basis of ethnicity، religion، language or race، through a dual plan، divided into two sections، each section has two requirements: The first section addressed the conceptual framework of the right of the prisoner of war to practice religious rituals، and the second section addressed the right to apply it in the texts of Islamic jurisprudence and the articles of the Third Geneva Convention of 1949. The study demonstrated the nature of freedom of belief and its guarantees in Islamic jurisprudence and the Third Geneva Convention، and finally concluded with a set of results and recommendations، the most important of which are: that human freedom does not entitle him to infringe on the rights of others، especially when it comes to freedom of belief، and that practicing his religious rituals is established and guaranteed in Islamic jurisprudence and various international conventions: global and regional. Based on the above، there is an urgent need to activate the right of the prisoner In the practice of religious rituals، in theory and application، supervision، monitoring and follow-up، by establishing bodies or institutions that follow up on the consideration of complaints related to the practice of freedom of religion with complete neutrality and integrity.
