الضوابط القانونية لممارسة الشعائر الدينية لغير المسلمين في التشريع الجزائري Legal Controls For The Practice Of Non-muslim Religious Rites In Algerian Legislation

Résumé: يهدف البحث في الموضوع إلى تحديد شروط وقواعد ممارسة حرية المعتقد والشعائر الدينية لغير المسلمين في التشريع الجزائري والقيود الواردة على ذلك، باعتبار أن ضبط الممارسات والشعائر الدينية لغير المسلمين في الجزائر يعد آلية حقيقية لضمان وتفعيل مبدأ الإسلام دين الدولة وحرية المعتقد، وتماشيا مع القواعد الدولية المنظمة لحرية المعتقد أو الدين. وأفرزت الدراسة أهمية التنظيم القانوني لحرية المعتقد أو ممارسة الشعائر الدينية أو العبادات ضمانة من شأنها كفالة حق الفرد في المعتقد أو ممارسة الشعائر الدينية أو العبادات في الجزائر وتنظيمها، والموازنة بين مبادئ الشريعة الإسلامية والتشريعات الداخلية ومبادئ وإعلانات حقوق الإنسان بشأن حرية المعتقد أو ممارسة الشعائر الدينية. الكلمات المفتاحية: تنظيم قانوني، حرية المعتقد ، الشعائر الدينية، غير مسلمين، عبادات، تظاهرات دينية Abstract The aim of the research is to define the conditions and rules for the exercise of freedom of belief and religious rituals of non-Muslims in Algerian legislation and the restrictions contained in it, because controlling the religious practices and rituals of non-Muslims in Algeria is a mechanism to ensure and activate the principle of Islam, the religion of the state and freedom of belief in line with international norms of freedom of belief. The legal regulation of freedom of belief, religious practice or worship is a guarantee of the individual's right to practice religious rites or worship in Algeria, and to balance the principles of Islamic law with internal legislation and declarations of human rights on freedom of belief or religious practice.
