المسؤولية الجزائية للمحامي عن إفشاء السر المهني

Résumé: الملخص: يعد السر المهني بالنسبة للمحامي من الالتزامات القانونية والأخلاقية التي تقع على عاتقه، فما يطلع عليه المحامي من معلومات ووثائق من طرف موكله أو من طرف سلطة التحقيق هي ذات طبيعة خاصة سواء كان ذلك أثناء ممارسته لمهنته أو بسببها فإنها تعد معلومات ذات طبيعة سرية يستوجب إحاطتها بالكتمان من خلال التزام المحامي بالحفاظ عليها وعدم إفشائها على عامة الناس حماية لمصلحة مشروعة ما لم تكن هناك ضرورة تبيح الإفشاء. كما أن المحامي يتقيد بهذا الالتزام استنادا لعقد الوكالة بينه وبين الموكل أو استنادا لنص القانون، وحماية لمصلحة صاحب السر أو المصلحة العامة فقد اهتم المشرع الجزائري بالسر المهني للمحامي سواء من خلال قانون تنظيم مهنة المحاماة أو من خلال قانون العقوبات حيث قام بتجريم فعل الإفشاء ورتب عليه قيام المسؤولية الجزائية للمحامي بموجب المادة 301 من قانون العقوبات. Abstract: The lawyer’s professional secret is among the legal and moral obligations that fall upon him. The information and documents that the lawyer views from his client or the investigation authority are of a special nature, whether during the exercise of his profession or because of it, it is considered confidential information that must be kept secret through The lawyer’s obligation to preserve it and not disclose it to the general public in order to protect a legitimate interest unless there is a need for disclosure to be permitted. In addition, the lawyer adheres to this obligation according to the agency’s contract between him and the client or according to the text of the law, and to protect the interest of the owner or the public interest. The criminal responsibility of the lawyer is established under Article 301 of the Penal Code.
