خطاب الكراهية والتمييز إشكالية قانونية أم مجتمعية

Résumé: ملخص: حاول المشرع من خلال القانون المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، وضع إطار قانوني شامل للجوانب المرتبطة بالظاهرتين اللتين أصبحتا تؤرقان جميع دول العالم بالنظر إلى الأبعاد الخطيرة التي وصلت إليها والتي سهل ارتكابها التطور غير المسبوق لوسائل الإعلام والاتصال وأشار النص إلى أن تجريم التمييز وخطاب الكراهية لا يهدف إلى الحد من حرية التعبير، بل يهدف إلى منع هذه الممارسات من بلوغ حدود التحريض على التمييز والعداء والعنف، وذلك قصد ضمان أمنهم وسلامتهم وحرمتهم الجسدية والنفسية وكرامتهم. كلمات مفتاحية: خطاب الكراهية، التمييز، التحريض، التمييز، التجريم، العقاب. Abstract: The legislator tried through the Law on Prevention and Combating of Discrimination and Hate Speech to establish a comprehensive legal framework for aspects associated with the two phenomena that have become daunting to all States of the world in view of the serious dimensions they have reached and which have been facilitated by the unprecedented development of the media and communication. The text indicates that the criminalization of discrimination and hate speech is not aimed at limiting freedom of expression, Rather, it aims to prevent such practices from reaching the limits of incitement to discrimination, hostility and violence, in order to ensure their security, integrity, physical and psychological inviolability and dignity.
