مقصد العدل وأثره في عقد الإجارة في ظل ظروف جائحة "كورونا"

Résumé: تسعى هذه الورقة البحثية لإبراز مقصد العدل وتجلياته في التصرفات المالية من خلال دراسة أحكام عقد الإجارة في ظلّ ظروف جائحة "كورونا"، وبيان مدى إمكانية الاستناد على مقصد العدل لرفع الضرر الواقع على الطرف المتضرر. تبيّن لنا من خلال هذه الدراسة أن لتوظيف مقصد العدل دور مهمّ في الحفاظ على التوازن العقدي في عقد الإجارة من خلال إعماله في حلّ النزاع بين المستأجر والمؤجر في زمن الطوارئ والجوائح. This research paper seeks to reveal the importance of fairness in financial transaction contracts by studying the provisions of the lease contract in the circumstances of the Coronavirus pandemic, and to indicate the extent to which the principle of justice can be relied on in settling financial disputes to eliminate the harm that is caused to the affected party. Through this study it became clear to us that the application of the principle of justice has an important role in finding a solution that takes into account the interests of both parties in lease contracts in times of emergency and epidemics.
