مصير حقوق ركـاب النقل الجوي العمومي في ظل تدابير مواجهة وباء فيروس كورونا (كوفيد-19)

Résumé: يشكل فيروس كورونا ( كوفيد ـ19ـ)، حسب المنظمة العالمية للصحة طارئة من ‏الطوارئ الصحية العمومية التي تثير قلقاً دولياً، قبل وصفه لاحقا بالجائحة العالمية، ويعود السبب الرئيسي في انتشاره السريع عبر العالم بأكمله خاصة إلى النقل الجوي الدولي للركاب، وهو ما دفع بالسلطات العمومية إلى اتخاذ تدابير للوقاية من هذه الجائحة ومكافحتها، أهمها تعليق الخدمات الجوية لنقل الركاب، وفرض إجراءات الحجر الصحي، مما سبب في إلغاء وتجميد العديد من الحجوزات من قبل شركات الطيران، وهو ما يطرح مشكل مصير حقوق الركاب المرتبطة بعقد النقل، سواء الأصلية منها أو البديلة، خاصة مع تمسك الناقلين بدفع المسؤولية عنهم، بسبب القوة القاهرة، وقصور أحكام المرسوم التنفيذي رقم 16/175 في تنظيم وتوضيح بعض المسائل ذات صلة بحقوق الركاب، لاسيما في الظروف الاستثنائية. According to the World Health Organization, the coronavirus (Covid-19), constitutes a public health emergency of international concern, before it was later described as a global pandemic. The main reason for the rapid spread of COVID-19 across the world is due to the international air transport of passengers, which prompted public authorities to take measures to prevent and combat this pandemic. Some of these important measures involve the suspension of air services to transport passengers, and the requirement of quarantine procedures, which caused the cancellation and freezing of many reservations by airlines. Such disruption raises the problem of the fate of passengers’ rights associated with the original or alternative transport contract, especially with the carriers insisting on avoiding their responsibility due to force majeure, and the inadequacy of the provisions of Executive Decree No. 16/175 in organizing and clarifying some issues related to passengers’ rights, particularly under exceptional circumstances.
