خصوصية الشكلية عقود الترقية العقارية - عقد البيع بناء على تصاميم و عقد الحفظ -

Résumé: الملخص: اعتبر المشرع عقود الترقية العقارية (عقد البيع على التصاميم و عقد حفظ الحق ) من العقود التي تعد الشكلية فيهما ركن للإنعقاد ، حسب ما جاء به القانون رقم 11/04 المتعلق بنشاط الترقية العقارية ، يظهر هذا الركن في مراعاة الرسمية المتمثلة في تحرير العقد من قبل موثق مختص، و التقيد بالبيانات الإلزامية التي تضمنها المرسوم رقم 13/431 المؤرخ في 18/12/2013 المحدد لنموذجي عقد البيع على التصاميم وعقد حفظ الحق ، بالإضافة إلى شهر العقد لدى المحافظة العقارية المختصة ، رغم أن محل العقد غير موجود في عقد البيع على التصاميم و هو ما يعد خروجا عن القواعد العامة . بينما ركن الشكلية في عقد حفظ الحق نجده يقتصر على مراعاة إجراء الرسمية دون الشهر ، رغم أن محل العقد يتمثل في حجز بناية غير منجزة ، و في ذلك أيضا خروجا عن القواعد العامة . Abstract: The legislator considered the contracts for the promotion of real estate (the contract of sale on the designs and the contract for the preservation of the right) of the contracts, which are formal form of the corner of the meeting, as provided by Law No. 11/04 on the promotion of real estate. The formality aspect of the contract of sale is based on designs in the official consideration of editing the contract by a competent notary, while complying with the mandatory data contained in the decree No. 13/431 of 18/12/2013 specifying the two forms of the contract of sale on the designs and contract of preserving the right, To the month of the contract at the competent real estate governorate, although the place of contract does not exist, which is a departure from the general rules. While the formal aspect of the contract of preservation of the right, we find it limited to taking into account the formal procedure without the month, although the place of the contract is the reservation of an unfinished building, and also out of the general rules.
