المبادئ العامة لعقد تفويضات المرفق العام في ظل المرسوم الرئاسي 15/247.

Résumé: يعتبر عقد تفويض المرفق العام من بين أهم المستجدات التي جاء بها المرسوم الرئاسي 15/247 المتعلق بالصفقات العمومية وتفويضات المرفق العام، وفي إطار مواكبة هذا المستجد إثراءا لمجال البحث القانوني في الجزائر، جاءت دراستنا هاته التي تهدف لتسليط الضوء على جزء هام من هذا العقد والمتمثل في المبادئ العامة التي تحكمه المنصوص عليها في المادة 209 من نفس المرسوم، وذلك من خلال بحث أحكام ومواد المرسوم الرئاسي 15/247 ودراستها للوقوف على مدى مساهمتها في تكريس هذه المبادئ ووضع الآليات والضمانات الكفيلة بتفعيلها على أرض الواقع. وبعد بحث ودراسة هذه المواد والأحكام توصلنا لأربعة نتائج يمكن إجمالها في القول بأن المبادئ العامة المنصوص عليها في المادة 209 من المرسوم السابق، هي ضمانات هامة للمرفق العام المفوض وطرفي عقد تفويضه تحتاج لمزيد من التفعيل. Abstract : The mandate contract of the General establishment shall be considered Among the most important News mentioned in Presidential Decree 15/247 relating to public markets, and in keeping with this new and enriching lawfully research field in Algeria, this study aims to shed light on an important part of this contract which is the general principles that govern it As stipulated in Article 209 of the same decree, through the examination and study of the provisions and articles of Presidential Decree 15/247 to determine the extent of their contribution to the establishment of these principles and the establishment of mechanisms and guarantees to activate them on the reality . After examining and studying these articles and provisions, we reached four conclusions which can be summed up in saying that the general principles stipulated in Article 209 of the previous decree are important guarantees for the public establishment and two parties to a mandate contract that need to be further activated.
