التكريس الدستوري لحرية الاستثمار والمزايا المستحدثة لتشجيعه

Résumé: إن الهدف من هذه الدراسة هو تسليط الضوء على الرؤية الاستثمارية الجديدة التي تبناها المشرع الجزائري سنة 2016 لتحفيز وتشجيع الاستثمارات في الجزائر، حيث قام بأمرين هامين في هذا المجال لتجنيد مساعيه نحو تحقيق أهدافه المرجوة لتحريك عجلة التنمية الاقتصادية وللخروج من التبعية لسوق المحروقات، متتبعا في ذلك فلسفة جديدة مفادها الانفتاح الاقتصادي وتخليه عن دوره الكلاسيكي، لذلك نص على تأكيده صراحة على حرية الاستثمار ليخطو خطوة مهمة نحو تجسيد هذا المبدأ الذي يعتبر عنوانا لبيئة استثمارية خصبة واعتباره مبدأ دستوريا من خلال دستور 2016، ليقوم بعد ذلك بإصدار قانون 16-09 المتعلق بترقية الاستثمار حيث نص على إعادة صياغته للمزايا وإزالة كافة العراقيل الإجرائية التي من شأنها تعطيل الاستثمارات، لتتلائم ورغبته في الوصول إلى قانون جاذب ومشجع للاستثمار في الجزائر.The aim of this study is to highlight the new investment vision adopted by the Algerian legislator in 2016 to stimulate and encourage investment in Algeria, where he has done two important things in this field to recruit his efforts towards achieving his goals to move the wheel of economic development and to get out of the fuel dependency market, following a new philosophy of economic openness and abandoning his classical role, so he expressly affirmed the freedom of investment to take an important step towards the embodiment of this principle, which is considered the title of a fertile investment environment, and consider it a constitutional principle through the Constitution of 2016, to then pass the law 16-09 on an investment promotion, which provided for the reformulation of the benefits and removing all procedural obstacles that would disrupt investments, in order to fit his desire to reach an attractive and encouraging law for investment in Algeria.
